How to handle bequest inquiries
All inquiries, regardless of whether they are from a member of the public, a widow/ers or a supporter should be handled in the following way:
Step 1. Collect contact details of inquirer:
Christian Name
Surname
Phone number
Address
Email
Portal identification number if available
Step 2. Pass to Bequest Manager
Email these details to Sally Gardner, Legacy Brisbane’s Donor Liaison Manager: sgardner@legacybrisbane.org.au or phone 0423 859 330.
The Donor Liaison will respond to the inquirer as soon as possible.
Will Making by Solicitors during COVID-19 Pandemic
We have received confirmation that solicitors are still operating as an essential service through the COVID-19 crisis. Solicitors will do all that is required to complete the Will under the Law.
We have been advised that solicitors’ preference is for the client to attend their office to take Will instruction. However, failing this where the client is unable to attend the solicitor’s office, instructions can be taken by teleconference/phone. The draft Will is then either emailed or sent by post and the solicitor will then contact the client by phone and walk them through the document. With regards execution of the Will, which requires signing the Will in front of two witnesses, the solicitor will include instructions on how to sign and complete this step. At this time, for example, it could be two neighbours standing on the driveway observing the signature. Should the client be unable to provide two witnesses, then a solicitor from their practice would attend the house, again business would be completed on a porch or driveway.
Making a gift in your Will
Making a gift in your Will is an important and very personal decision. When making your Will we recommend that you consider your loved ones first and foremost. Many people also find a place in their Will for causes that they believe are important and are close to their hearts.
We are honoured when people make the kind and generous decision to include a gift to Legacy Brisbane in their Will. By remembering us, you are ensuring that we can make the long-term commitment necessary to continue to fund our essential support services to the families of our fallen heroes from all conflicts since World War 1. Today, Legacy, together with our wonderful volunteers and generous supporters, continue to ensure that our solemn promise to our fallen and incapacitated heroes is kept – we will indeed ‘look after the Missus and the kids’.
We are honoured by your kind consideration. Any bequest to Legacy Brisbane, large or small, is sincerely appreciated and will never be forgotten.
If you would like more information about leaving a gift in your Will, please contact our Donor Liaison Manager, Sally Gardner, on 07 3029 5607 or mobile 0423 859 330 or sgardner@legacybrisbane.org.au
As this is a legal matter, we recommend you seek advice from a solicitor to ensure that the wording of your Will reflects your exact wishes. It is important to remember to review your Will regularly, particularly when life circumstances change. There are several ways of leaving a bequest, dependent on what is best for you and your family. Below is some suggested wording to accommodate most bequest provisions in your Will.

[CHOOSE ONE OF ABOVE OPTIONS]
1.2 I declare that in the case of a gift to a charitable or similar organisation (‘the charity’) in this Will (unless otherwise stated in the gift):
- a) it is made with a charitable intention and may be applied for the general purposes of the charity;
- b) it may be given to the treasurer, secretary or other proper officer of the charity and the receipt of that person will be an absolute discharge to my Executors;
- c) if the charity has changed its name or amalgamated with any other organisation or transferred all its assets to any other organisation (‘the new charity’) then my Executors will give the gift to the new charity;
- d) that cannot take effect, the gift will instead be given to a charity in Australia which my Executors consider most nearly fulfils the objects I intend to benefit;
- e) if there is any dispute or uncertainty as to the interpretation of the gift, the charity I intend to benefit or the purpose I wish to fulfil, my Executors will decide the issue and their decision will be final.
